3. About Fill My Ride and Pricing Data

3.1 Fill My Ride is a consumer service that helps Western Australian drivers find cheaper fuel. The website and our mobile application use fuel price data published by FuelWatch, a service of the Government of Western Australia (Consumer Protection, Department of Energy, Mines, Industry Regulation and Safety).

3.2 FuelWatch data is used in accordance with FuelWatch's published terms. FuelWatch is acknowledged as the source of all fuel price data displayed on this website, and we provide a link back to www.fuelwatch.wa.gov.au.

3.3 EV Pricing data is provided by ChargeFox.

3.4 Fill My Ride is not affiliated with, endorsed by, or operated by FuelWatch, ChargeFox, the Government of Western Australia, or any fuel retailer named on this website unless expressly stated.

3.5 Fuel prices shown on this website are sourced from the FuelWatch RSS feed and are refreshed on a regular schedule. Prices are accurate to the best of our knowledge at the time of publication, but we do not guarantee their accuracy or currency at the moment you view them. Always confirm the price at the bowser before purchasing.

3.6 ChargeFox publishes prices and charging status for its own charging network. Prices and charger availability are accurate to the best of our knowledge at the time of publication, but we do not guarantee their accuracy or currency at the moment you view them. Always confirm the price and availability at the EV station before purchasing.

4. Materials on the Website

4.1 This website contains material which is owned by or licensed to Fill My Ride. This includes, but is not limited to, the design, layout, look and feel, graphics, logos, text, software, and the Fill My Ride name and brand. This material is protected by Australian and international intellectual property laws, including the Copyright Act 1968 (Cth).

4.2 Trademarks, logos and brand names of fuel retailers, loyalty programs and other third parties shown on this website are the property of their respective owners. Their appearance does not imply any endorsement or affiliation.

4.3 You may view, use, download and temporarily store material from this website for your personal, non-commercial use only. You must not:

  • reproduce, republish, transmit, distribute, sell, license, or otherwise commercially exploit any material from this website;

8.2 We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). 8.3 You may request access to, correction of, or deletion of your personal information at any time by contacting privacy@fillmyride.com.au.

9. Liability

9.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law where it cannot lawfully be excluded.

9.2 Subject to clause 9.1, and to the maximum extent permitted by law:

  • the website and its content (including all fuel prices, savings calculations, route plans and recommendations) are provided without warranty of any kind, whether express or implied;
  • we are not liable for any loss, cost, damage or expense (including loss of profit, loss of savings, fuel costs, travel costs, or consequential or indirect loss) arising from your access to or use of the website, reliance on any information on the website, or any inability to access the website.

9.3 Without limiting clause 9.1, we will be responsible for loss or damage where it is:

  • (a) personal injury or death resulting from our negligence;
  • (b) caused by our fraud or fraudulent misrepresentation; or
  • (c) any other liability that cannot lawfully be excluded.

9.4 Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to:

  • in the case of services - re-supplying the services or paying the cost of having the services re-supplied;
  • in the case of goods - replacing the goods or paying the cost of replacement.

9.5 You agree to indemnify us against any loss, cost, damage or expense we suffer arising from your breach of these Terms or your misuse of the website.

10. Complete Agreement

These Terms (including the Privacy Policy) constitute the entire agreement between you and Fill My Ride in relation to your use of the website and supersede any prior agreement, representation or understanding.

11. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

12. Jurisdiction and Governing Law

12.1 This website is controlled and operated by Fill My Ride from its offices in Western Australia.

12.2 These Terms, and any dispute arising out of or in connection with these Terms or your use of the website, are governed by the laws of Western Australia, Australia.

12.3 You and Fill My Ride submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts competent to hear appeals from those courts.

12.4 Your continued use of this website indicates your acceptance of these Terms.
