End User Licence Agreement and Terms of Use

1. About this Agreement and the App Operator

1.1 This End User Licence Agreement and Terms of Use ("Agreement") is a legal agreement between you ("you", "your") and Fill My Ride (ABN 53 932 312 196) of Willetton, Western Australia ("Fill My Ride", "we", "us", "our") and governs your download, installation and use of the Fill My Ride mobile application and any associated services, content, updates and documentation (together, the "App").

1.2 By downloading, installing, registering for or using the App, you confirm that you have read, understood and agree to be bound by this Agreement and our Privacy Policy. If you do not agree, do not install or use the App, and uninstall it from your device.

1.3 You must be at least 16 years old to use the App. If you are under 18, you confirm that a parent or guardian has reviewed this Agreement on your behalf.

2. About the App and Pricing Data

2.1 Fill My Ride is a fuel-savings app for Western Australian drivers. The App displays fuel prices sourced from FuelWatch, a service of the Government of Western Australia, and provides personalised tools (including vehicle profiles, true-cost calculations, route planning, price alerts, loyalty discount integration and fill-up logging) to help you make better fuel-purchasing decisions.

2.2 Fuel price data is provided by FuelWatch under its published terms. FuelWatch is acknowledged as the source of all fuel price data displayed in the App, www.fuelwatch.wa.gov.au.

2.3 EV Pricing data is provided by ChargeFox.

2.4 Fill My Ride is not affiliated with, endorsed by or operated by FuelWatch, ChargeFox, the Government of Western Australia, or any fuel retailer, loyalty program, vehicle manufacturer or third-party service shown in the App, unless expressly stated.

2.5 FuelWatch publishes prices that retailers within the FuelWatch boundary are required by law to submit. Tomorrow's prices are available within the App after they are published by FuelWatch each day (typically after 2:30pm AWST). We do not control when, how often, or whether FuelWatch publishes data, nor how accurate this data is.

2.6 ChargeFox publishes prices and charging status for its own charging network. Prices and charger availability are accurate to the best of our knowledge at the time of publication, but we do not guarantee their accuracy or currency at the moment you view them. Always confirm the price and availability at the EV station before purchasing.

3. Licence to Use the App

3.1 Subject to your compliance with this Agreement, Fill My Ride grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on a mobile device that you own or control, for your personal, non-commercial use only.

3.2 You must not, and must not allow any other person to:

  • copy, modify, adapt, translate, reverse engineer, decompile or disassemble the App, except to the extent expressly permitted by law;
  • rent, lease, lend, sell, sublicense, distribute or otherwise commercially exploit the App;
  • remove, obscure or alter any copyright, trademark or other proprietary notice;
  • use the App to scrape, harvest or systematically extract fuel price data or any other data for republication or commercial use;
  • use the App in any way that breaches any applicable law or regulation, or that infringes any third party's rights;
  • use any automated system, bot or script to access the App or its underlying APIs;
  • attempt to gain unauthorised access to the App, our servers, other users' accounts, or any data that is not yours;
  • use the App in any way that could damage, disable, overburden or impair the App or interfere with another user's enjoyment of the App.

3.3 Any rights not expressly granted to you under this Agreement are reserved by Fill My Ride.

4. Account Registration

4.1 Some features of the App require you to create an account. When registering you must provide accurate, current and complete information and keep that information up to date.

4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@fillmyride.com.au if you suspect unauthorised access.

4.3 We may suspend or terminate your account at any time if we reasonably believe you have breached this Agreement.

5. Subscription, Free and Paid Tiers

5.1 The App is offered on a freemium basis. The free tier provides core features. Paid subscription tiers (such as Fill My Ride Pro and Fill My Ride Family) unlock additional features. Current prices, features and any free-trial terms are shown in the App at the point of purchase.

5.2 Subscriptions are sold and billed through the Apple App Store (for iOS) or Google Play (for Android). Payment, renewal, cancellation and refund terms are governed by the platform's standard rules in addition to this Agreement.

5.3 Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. To manage or cancel your subscription, use the subscription settings in your Apple ID or Google Play account.

5.4 Where a subscription is purchased through Apple or Google, refund requests must generally be made directly to that platform. Where a refund is required by the Australian Consumer Law, you may also contact us at support@fillmyride.com.au.

5.5 We may change subscription prices and features. We will give you reasonable notice (and, where required by law, the option to cancel without penalty) before any price increase takes effect.

6. Vehicle, Location and Personal Data

6.1 Vehicle profile data

To deliver personalised features (such as the True Cost Calculator and tank-cost estimates), the App allows you to enter or auto-populate vehicle details, including make, model, year, engine size, fuel type, tank capacity and fuel economy.

We retain only the specifications needed to power the App's features (for example, fuel economy and tank capacity). We do not store your VIN, registration status, or vehicle history and we do not link this information to any external identity database.

You can review, edit or delete your vehicle profile at any time in Settings → My Vehicles.

6.2 Location data

To deliver location-aware features (such as Smart Location Anchors, nearest-station search, route planning and the True Cost Calculator), the App will, with your permission, access:

  • your device location (GPS) when you use location-based features; and
  • any Home or Work addresses you choose to save as anchors.

You may grant location access "While Using the App", "Always", or deny it entirely. Some features may not work without location access; we will tell you which.

Your saved Home and Work addresses are encrypted at rest using AES-256 and in transit using TLS 1.3. They are stored only as latitude/longitude coordinates, not as street addresses, on our servers (where applicable). They are never sold or shared with third parties for advertising or any other purpose.

You can delete all saved location data at any time in Settings → Privacy → Delete My Location Data.

6.3 Photos for OCR features

If you use the Bowser Photo Capture, Fuel Receipt Photo Capture or Dashboard Photo Reader features, the App will use your device camera to capture an image. Wherever possible, the image is processed entirely on your device using on-device machine learning, and the raw photo is not uploaded to our servers. Where on-device processing fails and a cloud fallback is required, the photo is transmitted securely, processed for text extraction only, and deleted immediately afterwards.

You can disable camera access at any time in your device's settings.

6.4 Loyalty and discount data

If you configure personal discounts or loyalty programs (for example, a Coles Flybuys docket or RAC member discount), this information is stored locally on your device. It is used only to compute your effective price at relevant stations. It is not shared with retailers or loyalty providers without your explicit consent.

6.5 Privacy Policy

Our full Privacy Policy at fillmyride.com.au/privacy governs how we collect, use, store, disclose and dispose of personal information, and forms part of this Agreement. We comply with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Notifiable Data Breaches scheme.

You have rights under Australian privacy law to access, correct and (in certain circumstances) request deletion of your personal information. Contact us at privacy@fillmyride.com.au.

7. Push Notifications and Communications

7.1 With your permission, the App may send you push notifications, including price alerts, "wait or fill now" predictions, fill-up reminders and product updates. You can disable any or all notifications in Profile → Notification Preferences or in your device's notification settings.

7.2 We may send you transactional emails (for example, account confirmations or subscription receipts) and, where you have opted in, marketing emails. You can unsubscribe from marketing emails at any time using the unsubscribe link in the email.

8. Accuracy, Estimates and No Reliance

8.1 Fuel prices in the App are sourced from FuelWatch, EV prices and charger availability from ChargeFox and refreshed on a regular schedule. Prices and charger availability are accurate to the best of our knowledge at the time of publication, but we do not guarantee their accuracy or currency at the moment you view them or at the moment you arrive at the station. Always confirm the price displayed at the station before purchasing.

8.2 Savings calculations, true-cost estimates, fuel-economy figures, range estimates, route plans, distance estimates, "wait vs fill now" recommendations, and dashboard/bowser OCR readings are estimates only and may be inaccurate due to factors including (but not limited to):

  • rounding and unit-conversion;
  • traffic, road conditions and the route actually taken;
  • variations in real-world fuel economy compared to manufacturer figures;
  • delays in price updates from retailers or FuelWatch;
  • OCR misreads from photos;
  • changes to loyalty program terms or discount eligibility.

8.3 You should not rely on App estimates for decisions where accuracy is critical (for example, deciding whether you have enough fuel to reach a destination). Always check your vehicle's actual fuel gauge and odometer.

9. Loyalty Programs and Third-Party Discounts

9.1 The App may allow you to record discounts from loyalty programs such as Flybuys, Everyday Rewards, RAC, 7-Eleven Fuel Price Lock, BP Rewards and similar schemes. We are not responsible for the terms, eligibility, redemption rules or expiry of any third-party loyalty program.

9.2 Effective prices shown in the App after discounts are applied are estimates based on the rules you configure. The actual price you pay is determined by the retailer at the point of sale. Always confirm any discount applies before purchasing.

9.3 We are not liable if a loyalty program changes its terms, ceases operation, refuses to honour a discount, or otherwise affects your savings.

10. Materials and Intellectual Property

10.1 The App, including its software, design, graphics, logos, text, sound, the Fill My Ride name and brand, and all other content (other than fuel price data sourced from FuelWatch, ChargeFox and third-party trademarks acknowledged in the App), is owned by or licensed to Fill My Ride and is protected by Australian and international intellectual property laws.

10.2 Trademarks of fuel retailers, loyalty programs, vehicle manufacturers and other third parties displayed in the App are the property of their respective owners and are used for identification purposes only.

10.3 The licence granted in clause 3 does not transfer any ownership rights to you.

11. App Stores

11.1 If you obtain the App from the Apple App Store, you acknowledge that this Agreement is between you and Fill My Ride only, and not with Apple. Apple is not responsible for the App or its content. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

11.2 If you obtain the App from Google Play, you acknowledge that this Agreement is between you and Fill My Ride only, and not with Google. Google is not responsible for the App or its content.

11.3 You must comply with the applicable App Store's terms of service in addition to this Agreement.

12. Updates, Availability and Changes

12.1 We may release updates to the App from time to time. Some updates may be required to continue using the App. You are responsible for installing updates.

12.2 We may add, modify or remove features, change pricing of paid tiers (with reasonable notice), or discontinue the App at any time.

12.3 We do not guarantee that the App will be available, uninterrupted, error-free, secure, or compatible with every device or operating system version.

13. Liability

13.1 Nothing in this Agreement excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law where it cannot lawfully be excluded. You may have rights under the Australian Consumer Law that this Agreement does not affect.

13.2 Subject to clause 13.1, and to the maximum extent permitted by law:

  • the App and all content, estimates, calculations, recommendations and notifications are provided without warranty of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement;
  • we are not liable for any loss, cost, damage or expense (including any loss of profit, loss of savings, fuel cost, travel cost, vehicle damage, missed opportunity, or any indirect or consequential loss) arising from your use of, or inability to use, the App, reliance on App content or estimates, or any failure of the App.

13.3 Without limiting clause 13.1, we will be responsible for loss or damage where it is:

  • (a) personal injury or death resulting from our negligence;
  • (b) caused by our fraud or fraudulent misrepresentation; or
  • (c) any other liability that cannot lawfully be excluded.

13.4 Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to:

  • in the case of services - re-supplying the services or paying the cost of having the services re-supplied;
  • in the case of goods - replacing the goods or paying the cost of replacement.

13.5 You agree to indemnify us against any loss, cost, damage or expense we suffer arising from your breach of this Agreement, your misuse of the App, or any content you submit through the App.

14. Termination

14.1 You may terminate this Agreement at any time by uninstalling the App and ceasing to use it. Cancellation of paid subscriptions is governed by clause 5.

14.2 We may suspend or terminate your access to the App at any time if you breach this Agreement or if we reasonably believe termination is necessary to protect us, other users, or the App.

14.3 Clauses 6 (Privacy), 10 (IP), 13 (Liability), 14 (Termination), 15 (Severability) and 16 (Governing Law) survive termination.

15. Severability

If any provision of this Agreement is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 This Agreement is governed by the laws of Western Australia, Australia.

16.2 You and Fill My Ride submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts competent to hear appeals from those courts.
